These Terms of Service govern your use of our website and services across the United Kingdom, European Union, and United States.


United Kingdom (UK)

3. Conclusion of a Contract

Your order is an offer to GT Omega Racing Ltd for the conclusion of a purchase contract. When you place an order at GT Omega Racing Ltd (www.gtomega.com, www.gtomega.co.uk, www.gtomega.eu), we will send you an email confirming receipt of your order and listing its details. This order confirmation is not an acceptance of your offer, it merely informs you that we have received your order. A purchase contract materializes only with the shipment of the dispatch confirmation or the delivery of the products.

4. Shipment, Delivery, and Payment

The delivery will follow ex-warehouse to the delivery address provided by the customer. Delivery and payment conditions will be detailed in the product description. There is no minimum order amount. GT Omega Racing Ltd is also entitled to limit the quantity ordered to commercial amounts.

We reserve the right to make partial deliveries if this is advantageous for speedy handling and reasonable for the customer. Orders will have an additional shipping cost applied at checkout, which will be visible before payment confirmation. Special forms of shipment requested by customers will be billed with customary additional fees.

Payment is due immediately after placing the binding order. Unless agreed otherwise, payments must be made via prepayment, credit card, or PayPal.

5. Delivery Times

Goods in stock will be dispatched within 1 to 2 working days after receipt of payment. If goods are unavailable at the time of the order, we will aim to deliver as soon as possible. In cases of failure to meet a delivery or service deadline due to unforeseen circumstances or force majeure, the deadline will be extended accordingly.

If delivery is not possible due to manufacturer or supplier issues and the agreed delivery date has been exceeded by more than 2 months, both we and the customer can cancel the contract. Claims for damages due to default, inability, or failure to fulfill obligations, even if arising from withdrawal from the contract, are excluded unless a legal representative of GT Omega Racing Ltd has acted with intent or negligence.

6. Right of Revocation

Customers have the right to withdraw from the contract within 14 days of receipt by providing reasons in text form (e.g., email) or by returning the goods if the return occurs before the withdrawal period expires. The withdrawal period begins upon receipt of the goods by the customer. For protection of the withdrawal term, timely dispatch of the revocation or goods is sufficient.

7. Passing of the Risk

Risk is transferred to the customer upon shipment of the goods. In the case of returns, the sender bears the risk, including transport risk, until the goods are received by GT Omega Racing Ltd.

8. Guarantee

GT Omega Racing Ltd guarantees that the purchased goods were free of material and manufacturing flaws at the time of delivery and conform to the quality described in the contract. Upon receipt, customers must inspect the goods for defects and notify us in writing within 5 days of discovery, including latent defects. The guarantee period is 12 months from the date of shipment.

9. Reservation of Title

GT Omega Racing Ltd reserves the title to all delivered goods and services until full payment is made for all claims resulting from the business relationship with the buyer.

10. Storage of Data

According to § 28 of the Federal Law for the Protection of Data (BDSG), we point out that data necessary for completing transactions is processed and stored electronically. Personal information will be treated confidentially. You have the right to free information, correction, blocking, or deletion of your stored data at any time. We do not share your personal data with third parties without explicit consent, except for service partners (e.g., shipping companies and payment processors) required to fulfill orders.

11. Concession of Rights, Customer Assessments

If you submit a customer assessment, you grant GT Omega Racing Ltd an unlimited, exclusive license to use the assessment for any online or offline purpose. GT Omega reserves the right to display or modify assessments at its discretion.

12. Place of Execution and Legal Venue

The place of execution and legal venue for both parties is the location of GT Omega Racing Ltd. The law of the United Kingdom applies exclusively.

13. Claims for Damages

Under no circumstance shall GT Omega Racing Ltd be responsible for any indirect, incidental, or consequential damages.

14. Severability Clause

If any clause of these Terms is invalid or unenforceable, the remaining clauses shall remain in full effect.

5. Delivery Times

Goods in stock will be dispatched within 1 to 2 working days after receipt of payment. If goods are unavailable when the order is made, we will strive for delivery as soon as possible. In case of failure to meet a delivery or service deadline due to an act of god, industrial conflict, unforeseen complication, or other circumstances not at our fault, the deadline will be extended accordingly. If delivery deadlines are missed for other reasons, the customer may set a new deadline and cancel the delivery if unmet. If delivery is not possible due to manufacturer or supplier issues, both we and the customer may cancel the contract if the agreed delivery date is exceeded by more than 2 months. Claims for damages due to delay or failure, including withdrawal from the contract, are excluded unless a GT Omega Racing Ltd representative has acted deliberately or negligently.

6. Right of Revocation

Customers are entitled to withdraw from the contract within 14 days of receipt by giving reasons in text form (e.g., email) or, if the goods have been delivered before expiration, by returning the goods. The term begins upon receipt of this instruction but not before the entrance of the goods at the receiver. Timely dispatch of the revocation or goods is sufficient for the protection of the withdrawal term.

In case of an effective withdrawal, both parties must refund services received. If you cannot return the services received in full or only in a deteriorated state, you must compensate for the value. This is not valid if deterioration was solely due to checking the goods. The customer must bear the expenses of the return and fulfill obligations for refund within 30 days after dispatch of the revocation.

7. Passing of the Risk

Risk passes to the customer upon shipment of goods. In case of returns, the sender carries the risk, including transport risk, until goods are received by GT Omega Racing Ltd.

8. Guarantee

GT Omega Racing Ltd guarantees that the purchased goods were free of material and manufacturing flaws at the time of transfer and conform to the agreed quality. Customers must inspect goods immediately upon receipt and report apparent defects within 5 days; otherwise, guarantee rights are excluded. The guarantee period is 12 months from shipment.

With complaints, the purchase date must be proven with a bill. Complaints must be sent with full accessories, a description of the error, and a copy of the delivery receipt, packed properly. The guarantee does not cover normal wear and tear, misuse, or modifications by the customer. Defects due to improper handling must be borne by the customer. GT Omega Racing Ltd has the right to remedy defects free of charge during the guarantee period.

9. Reservation of Title

GT Omega Racing Ltd retains ownership of delivered goods until complete payment of all current and future claims arising from the business relationship.

10. Storage of Data

According to §28 of the Federal Law for the Protection of Data (BDSG), we point out that data necessary for transaction completion is processed and stored electronically under §33 BDSG. Personal information will be treated confidentially. The ordering person explicitly agrees with the collection, processing, and use of personal information. You have the right to free information, correction, blocking, and deletion of your stored data at any time. We do not share your data with third parties without your explicit consent, except service partners involved in processing your order (e.g., shipping companies, payment processors), and only to the necessary extent.

11. Concession of Rights, Customer Assessments

If a user submits a customer assessment, they grant GT Omega Racing Ltd an exclusive, unlimited license for further use online and offline. GT Omega Racing Ltd reserves the right not to publish, limit publication time, or modify assessments. Customer assessments reflect customers’ opinions and do not necessarily reflect GT Omega Racing Ltd’s views.

12. Place of Execution and Legal Venue

For commercial customers, the place of execution and legal venue is the location of GT Omega Racing Ltd. For private customers, it is the customer's location. If the customer resides outside the United Kingdom, the exclusive venue is the location of GT Omega Racing Ltd. UK law exclusively applies.

13. Claims for Damages

Under no circumstance shall GT Omega Racing Ltd be responsible for any indirect, incidental, or consequential damages.

14. Severability Clause

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected. The invalid provision shall be replaced by a valid one closest in meaning.

 


United States (US)

If delivery is impossible due to supplier or manufacturer failure, either party may cancel the contract if the delay exceeds 2 months. Claims for damages are excluded unless a GT Omega Racing Ltd representative acted with intent or negligence.

Customers may withdraw from the contract within 14 days of receipt by written notice (e.g., email) or by returning the goods. The withdrawal period begins upon receipt of the goods. Timely dispatch of the revocation or return is sufficient.

If withdrawal is valid, services received by both parties must be returned. If you cannot return items fully or in original condition, you may owe compensation. This does not apply if the deterioration occurred from inspecting the item as you would in a store. Return shipping costs must be borne by the customer. Obligations for refunds must be fulfilled within 30 days of revocation.

8. Guarantee

GT Omega Racing Ltd guarantees that goods are free from material and manufacturing flaws at delivery and conform to contract specifications. Goods must be inspected immediately upon receipt. Defects must be reported in writing within 5 days of discovery; otherwise, guarantee claims may be void. The guarantee is valid for 18 months after shipment.

Complaints must be accompanied by proof of purchase and sent in the original packaging with all accessories, along with a detailed error description. The guarantee excludes normal wear and misuse. If the customer alters the product or uses it improperly, GT Omega Racing Ltd is not liable and the customer bears the cost. We reserve the right to correct defects free of charge during the guarantee period.

We will not share your data with third parties without consent, except to service partners required to fulfill your order (e.g., shipping and payment processing).

11. Concession of Rights, Customer Assessments

By submitting a review, you grant GT Omega Racing Ltd an unlimited license to use it online or offline. GT Omega may display, edit, or not publish reviews at its discretion. Reviews represent customer opinions and may not reflect GT Omega’s views.

12. Place of Execution and Legal Venue

For commercial customers, the place of execution and jurisdiction is the location of GT Omega Racing Ltd. For private customers, it is their place of residence. If a customer resides outside the UK, the venue remains GT Omega’s registered office. UK law exclusively applies.

13. Claims for Damages

GT Omega Racing Ltd is not liable for indirect, incidental, or consequential damages under any circumstances.

14. Severability Clause

If any part of these Terms is found invalid or unenforceable, the rest remains in effect. An enforceable clause closest in meaning will replace it.
